TERMS OF USE

What you're agreeing to by using The Counter Case.

Last updated: September 1, 2026

1. Who operates The Counter Case

The Counter Case is an independent educational project created and operated by Matanat Talibzada, based in Azerbaijan. It is not a company, an LLC, a university, or an accredited research institution.

These Terms of Use govern your use of The Counter Case. They work alongside the Privacy Policy, which explains what information is collected and why — this document is about what you can do here, and what you're agreeing to by using it.

2. What this platform is

The Counter Case is an interactive business-learning platform. You predict the outcome of a real business scenario, see the evidence behind what happened (or what a well-researched simulation shows), and reflect on how your thinking changed. Some cases are documented real events with sources; others are composed simulations grounded in research — every case states which, before you predict.

Professors can create classes, run live prediction sessions, and see results for the classes they run. Students can participate with or without an account.

3. Eligibility

The minimum age to use The Counter Case is 13 — for creating a learner account and for joining a class as a guest through /join. Users aged 13 to 17 are welcome; The Counter Case is not an adults-only service.

Depending on where you live and how you're using the platform, you may need a parent, guardian, or school's authorization — the Privacy Policy's “Young users” section covers this in more detail, and the same 13+ floor applies here without exception.

4. Accounts and classroom participation

Creating an account requires an accurate email address; you're responsible for keeping your password secure and for activity that happens under your account.

You can also participate in a live class as a guest, without an account, using a code and a display name. This doesn't create a permanent account. If you later sign in or create an account, you may be able to connect that guest participation to your account — but only from the same browser session that actually participated; this exists specifically so one person can't claim another participant's responses.

5. Educator verification

Applying for educator (professor) access requires an account and submitting your name, institutional email, and institution. The Counter Case reviews applications using a combination of automated checks and, where needed, manual review.

Being verified as an educator by The Counter Case means exactly that — verification performed by this platform. It does not mean your university or institution endorses, partners with, sponsors, or has adopted The Counter Case, and it does not mean you are speaking on behalf of your institution by using this platform.

6. Judgment Score

Judgment Score is an educational feedback feature. It's calculated from your prediction and confidence history, and gives you a read on whether your judgment tends to run overconfident, underconfident, or well-calibrated.

It is not an intelligence assessment, a psychological or clinical assessment, an academic grade, an admissions metric, an employability assessment, a financial or credit assessment, or a professional qualification or certification of any kind. Treat it as one narrow, self-reflective signal — not a score that means anything outside this platform.

7. Case content: Real Case vs. Simulation

Every case is labeled either a Real Case — a documented event with a cited source, presented as what actually happened — or a Simulation — a composed scenario grounded in research, never presented as a real, named company's actual results. That distinction is shown before you predict, and it's never blurred afterward.

The explanations, theory, and takeaways attached to each case are The Counter Case's own educational and editorial interpretation of the evidence it cites — not a restatement of what the cited researchers or sources themselves conclude, and not a claim that the underlying business principle applies universally. Good judgment includes knowing where a principle breaks down; where relevant, every case says so explicitly.

8. Educational purpose, not professional advice

The Counter Case is an educational platform. Nothing on it — including case content, the Experiment playground, or your Judgment Score — is financial, investment, legal, or professional business consulting advice, and it shouldn't be relied on as a substitute for it. This doesn't take anything away from what the platform is for: building better judgment through practice, not delivering advice for a specific decision.

9. User-submitted content

You retain ownership of the content you submit — reflections, display names, bug reports, and educator application details. By submitting it, you give The Counter Case the limited permission needed to store it, process it, display it back to you through the feature you submitted it to (for example, showing your own reflection when you return to a case), and operate the relevant account, classroom, or bug-report functionality.

We do not sell your content, use it in advertising, publish your reflections, or sublicense it for purposes unrelated to running the platform. Your prediction and confidence history feeds your own Judgment Score — it is never presented as evidence supporting the business claims made in a Counter Case case, and individual learner activity is never published.

10. Acceptable use

Beyond the ordinary expectation of not misusing the platform, please don't:

  • impersonate another participant or user
  • submit false information to obtain educator access
  • attempt to access another user's or class's information without authorization
  • attempt to guess, brute-force, or enumerate classroom join codes
  • deliberately interfere with a live classroom session
  • attempt to circumvent prediction-locking or other integrity controls
  • submit malicious, abusive, or illegal content as a display name, reflection, or bug report
  • scrape or bulk-extract Counter Case content beyond ordinary, reasonable use

11. Intellectual property

The Counter Case's original material — case writing and educational presentation, explanations and teaching structure, editorial material, interface and visual design, original graphics, professor-facing materials, and the underlying software — belongs to The Counter Case.

Cases also draw on third-party material: underlying academic research, factual information, papers, company names, trademarks, journal content, and links to external websites. The Counter Case doesn't claim ownership of any of that, and citing or linking to a source never implies that source endorses, sponsors, or partners with The Counter Case — nor that the source's authors endorse The Counter Case's interpretation of their work.

12. Professor and institutional relationships

Educator verification, as described above, means verification by The Counter Case alone. Use of the platform by a professor, or by any institution's students, does not by itself create any partnership, sponsorship, endorsement, or institutional relationship between The Counter Case and that institution.

The same applies in the other direction: a case citing a researcher, company, or institution's published work does not mean that person or organization endorses The Counter Case, or agrees with how a case interprets their research.

13. Access restriction

The Counter Case reserves the right to restrict access to the platform where reasonably necessary — for example, in response to a security issue, suspected abuse, unauthorized access attempts, false information submitted to obtain educator access, interference with a classroom session, or a serious violation of these Terms.

Right now, this is a reserved right, not a built system: The Counter Case does not currently have an account suspension, banning, or formal enforcement mechanism. Handling of any issue that arises today would be manual, on a case-by-case basis. A proper account-status and enforcement mechanism is a planned future engineering improvement, not something already in place.

14. Legal provisions not yet included

The following are deliberately not included in this document yet: a governing-law clause, a jurisdiction or dispute-resolution clause, an arbitration agreement, an indemnification clause, a limitation-of-liability clause, and a warranty disclaimer.

These are real, binding legal provisions, and The Counter Case is currently operated by a minor — which raises a genuine question about contractual capacity that needs an actual qualified legal opinion, not an assumption. Rather than publish language that might not be enforceable, or that was written without that review, these sections are being held until they can be done properly. This document will be updated, with a new date, once that happens.

15. Changes to these Terms

These Terms will be updated when what the platform actually does, or the legal provisions above, change in a meaningful way. The date at the top will always reflect the most recent real change.
